Enforcement body cameras not intended for documenting smoking violations


Government officials clarified yesterday that new cameras mandated under the Tobacco Control Act amendment are strictly for officer safety during volatile confrontations, not for gathering evidence on illegal puffing.
The Legislative Assembly’s Third Standing Committee held a detailed review of the proposed amendments to the regime on tobacco prevention and control yesterday.
Director of the Health Bureau (SSM) Alvis Lo and other government representatives attended the meeting to clarify upcoming operational changes.
Committee chairman Leong Sun Iok stated that the bill introduces the use of body-worn cameras for SSM tobacco control inspectors.
However, authorities emphasized that these cameras will not be used to collect primary evidence of illegal smoking offenses. Instead, the equipment is strictly designated for security purposes during dangerous, emergency, or disorderly situations encountered by staff in the line of duty.
Inspectors must verbally notify individuals before activating the cameras. The objective is to maintain an objective record to safeguard the rights and interests of both parties. Video footage will generally be retained for a maximum of seven days. The Health Bureau will finalize precise operational guidelines regarding camera usage, data retention, and deletion protocols after consulting the Personal Data Protection Bureau.
The government also unveiled plans to expand outdoor non-smoking mandates.
Mirroring the existing model used for public bus stops, authorities plan to establish non-smoking perimeters extending 10 meters from both sides of all entrances and exits at local primary schools, secondary schools, and hospitals.
The SSM said it will collaborate with relevant managing entities to finalize the exact boundaries for each location.
The amended law is slated to take effect in 2026. However, selected provisions will see a phased implementation. Notably, the introduction of mandatory standardized packaging for tobacco products will be deferred, officially taking effect in July 2027.
